I. General provisions

I.1 The Customer declares that he/she has read the general terms and conditions of Nounou Prestige applicable to the Order placed by the Customer with Nounou Prestige and has accepted them without reservation. Nounou Prestige reserves the right to modify the present terms and conditions, subject to individual notification of the Customer. These modifications will be applicable to orders in progress on condition that the Customer, duly notified, has not expressed his disagreement within 8 days of receipt by the Customer of the modifications.

I.2 The services offered by Nounou Prestige consist in the provision of personal services, and in particular family services (“the Services”). These services are described in the Baby Prestige brochure and on the www.nounouprestige.com website.

II. Description of Services

The Services entrusted by the Customer to Nounou Prestige are detailed in the order (“the Order”). In particular, this Order describes the price of the Service and the terms and conditions for performing the Service in terms of duration, timetable and place of performance.

III. Prices and terms of payment

III.1 The fixed, firm and definitive price of the Services is established in accordance with the price shown in the Nounou Prestige brochure and on the www.nounouprestige.com website. This price includes VAT. The price is payable on Order. Payment can be made in cash, by Paypal or by bank transfer to the Nounou Prestige account whose details appear on the invoice. The invoice is issued in duplicate for all Services, and one copy is given to the Customer on receipt of the Order.

III.2 The Service Provider reserves the right to unilaterally modify the price of the Services at any time, in particular in the event of an increase in costs, it being understood that, in the event of a price increase subsequent to the Order, only the price fixed on the date of this Order will be applicable to the Customer.

IV. Conclusion of the Order

The Order is definitively concluded on the date it is signed by the Customer, who hands it over to Nounou Prestige. Any request to modify the Services ordered by the Customer must be submitted to Nounou Prestige for acceptance.

V. Order duration

The Order is concluded for the duration mentioned in the order form.

VI. Order fulfilment

Nounou Prestige undertakes to provide the Services requested in accordance with the present terms and conditions and the terms and conditions set out in the Order. Nounou Prestige will not divulge any information relating to the Customer or the Customer’s property to which it may have had access in the performance of the Services.

VII. Non-Performance of Order

The Service Provider may not be held liable in the event of non-performance or improper performance of its obligations due either to the Customer’s fault, or to the insurmountable and unforeseeable fault of a third party, or to a case of force majeure.

VIII. Provision of staff

To perform the Services, Nounou Prestige will send one of its employees to the Customer’s premises. The employees of Nounou Prestige will remain under the subordination of Nounou Prestige which will provide them with the equipment necessary to perform the Services. General coordination is provided by Madame Souad, President of Nounou Prestige. At the beginning of the Services, Nounou Prestige may carry out an inspection with the Customer.

IX. Dispute resolution

All claims must be addressed to Nounou Prestige. If the Customer’s request for a claim is unsuccessful, the Customer may submit the dispute with Nounou Prestige to the mediator (specify contact details) who will attempt, independently and impartially, to bring the parties together in order to reach an amicable solution. In the absence of amicable agreement, any dispute or litigation concerning the interpretation and performance of the Services or the Order shall be submitted, at the plaintiff’s option, to the court of the defendant’s domicile or the place of performance of the Services in accordance with articles 42 and 46 of the French Code of Civil Procedure or, at the Customer’s option exclusively, to the court of the place where the Customer resided at the time of conclusion of the Order.
